ABSTRACT

This monograph aims to analyze the scope administrative disciplinary process Brazilian Army against the constitutional principle of due process, the important law concerning procedural harvest. Initially, it is a brief presentation of the government in Brazil, as the general aspects, principles of public administration with a focus on the principle of due process and the audit altered parted and also a brief analysis of the powers of government distinguishing between the types of crimes. After it approached the Brazilian Army in the civil service, thus demonstrating the peculiarities of military service, through the constitutional historical aspect, then conceptualizing disciplinary transgression and the demonstration of the possibility of filing of habeas corpus in military disciplinary proceedings, following a brief analysis on the outskirts of disciplinary power in the Brazilian Army. Finally we seek to analyze the disciplinary process in the disciplinary regulations of the Army, with explanation of the arrangements for limiting administrative sanctions of freedom, brief analysis of the principles of due and contradictory process in disciplinary proceedings from the scope of the Brazilian Army, the possibility of control judiciary as administrative offenses, as an important tool for ensuring the rights of defense and jurisprudential vision and potential for abuse. It is a study developed through extensive literature, legislative and judicial, which adopts the method of approach the hypothetical-deductive method in order to demonstrate the importance of the subject to exercise of the right of administrative defense, rights already enshrined in Constitution and own Army regulations, but often due to poor approach are not put in place for the military, recognition and respect for the constitutional rights of defense would culminate in the reduction of judicial processes that cause public expenditure on compensation for damage moral.
