ABSTRACT
A surrogate is a current issue that involves and controversial issues that challenge the Family Law and Law of Succession, as thoroughly interfere in the process of natural human procreation , creating , often confusing and puzzling situations with regard to relations membership and parentesco. O present work aims to go beyond the biological truth but a truth explain socio- affective where the rights and duties of the child are important for the establishment of filiação .Partindo of Roman law, Brazilian model of legal development, the determining family was formerly only by consanguinity factor , based on the known patriarchal family , where the man is the "head of household " designates the orders to be followed by the rest of the family . The woman was taken as the lower limb, obeying the rules but was severely punished. Therefore, this family composition began to decline when the Constitution of 1988 equaled legitimate children (those generated within marriage) and illegitimate children (those generated outside of marriage). However, both the Civil Code as the Federal Constitution of 1988 are quite shallow with respect to rights and duties of children generated from the artificial conception. Thus modified by social and biotechnological developments, is of paramount importance that the new pillars of membership are assessed in order to also meet the desires of the child conceived through gestational replacement or assisted reproduction.

1 – INTRODUÇÃO
O presente trabalho pretende analisar a reprodução humana através da barriga de substituição e da reprodução assistida. Abordando e compreendendo quais são os sujeitos da maternidade e paternidade em face do direito de família, sucessões, personalidade, identidade genética e diante do Conselho Federal de Medicina.
O tema, por ser robusto de aspectos polêmicos e controvertidos vem a despertar o interesse de doutrinadores, juristas e estudantes ao longo dos últimos anos. Por no Brasil, não existir uma legislação específica, torna o assunto muito mais interessante e emocionante de se pesquisar.
