ABSTRACT

This monograph aims to an analysis on the notes of the Institute of provisional stability and their replacement by pecuniary indemnification. In the present study, will address a brief history about the Institute of stability, which starts since the edition of Decree nº 4.682 of 24-01-1923 being called Law Eloy Chaves until its procedural developments in the Brazilian legal system. The topic covered in this monograph has the purpose of knowing the history of stability, its concept and the relationship of stability with the guarantee of employment. Subsequently, seeks to interpret and understand about the triggering factors of the remission of the employee and the legislation that regulates, since it is about the legal effects that the dispensation irregular entails for both parts of the employment relationship, which may necessitate until the nullity of the act performed. Important to mention the positioning of the legal system on the assumptions of the chargeability of investigation for the determination of serious misconduct as well as the replacement in pecuniary indemnification when it is inadvisable to his reinstatement to employment. Finalizing work with the third and last chapter where will be discussed the themes on the possibility of claim filing fees that labor may be sued in the justice of work to ensure the rights and especially the money labor and its respective calculation resulting from compensation.
