The recognition of the monoparental family and the children as holder of right, especially the children who are holder of fun

damental right different from the adults’ rights.The reflection concerning the theme of the research has shown that, the consequences for the family and for the children generated by the death of any of the responsible, especially during the childhood from zero to eighteen years old, is deep and several times irreparable. The identification of the monoparental family is a determining factor for the emergence of normative improvements. This research intends to show what the children and teenagers’ rights are in face of the accomplished research and a possible solution for the consequence generated to a new family now, once the mother is fundamental for the children and how the government is worried about the legislation in which needs to be added even some more rights, showing which ways the families may take to know about their lives. We have come to the conclusion that the importance the family law has must be extremely overt, due to the family’s relevance and their legal precision for each family.

Este trabalho tem como objetivo proporcionar maior familiaridade com o problema que se encontram os filhos que quando menos esperam, perdem um dos seus provedores principais, que antes era fonte de renda e conhecimento em casa, mas que com a morte, não terão mais o mesmo apoio para representá-los e protegê-los em suas vidas, para garantir seus valores.

As definições apresentadas a respeito da família monoparental, tendem a imaginar primeiramente como uma família composta apenas por mãe e filho, ou seja, a clássica, seguido por pai ou mãe e filhos pouco lembrada.

De acordo com Maria Helena Diniz (2010), muito grande é a importância do direito de família pela influência que exerce sobre todos os ramos
