ABSTRACT

This study has the objective to analyze the fundamental right that must to prevail in the case of antinomies, especially regarding the right to habitation and the ecological balanced environment, which are protected by the Federal Constitution of 1988, but recognized as human rights since the twentieth century. Therefore, beginning with a brief check of the legal formation of fundamental rights as a human right, and the right to have an habitation and a balanced environment, including the analysis of the historical evolution of these rights and the basic principles that forming the current environmental law. Forward, the study goes deeply in the study of the “Billings dyke”, more specifically the "braço Cocaia" as a way to illustrate the conflict of fundamental rights to habitation and the environment, before, however, by classifying the area as permanent preservation. At the end, is important to stands out the conflict of rights by pondering them from the case proposed, in theoretically plain, what should prevail, in this case, the right to a balanced environment, to solve the existing problem in the region.
