A presente produção científica tem por base a análise da adoção homoafetiva como nova concepção de família, expondo a transformação do conceito de família, aliado a evolução da legislação sobre o tema, evidenciando, assim, o seu papel e a sua importância perante a sociedade. Logo, trata-se nesta monografia, o desenvolvimento da família, a homossexualidade e o instituto da adoção e seus reflexos no decorrer dos anos. Ademais, serão abordados os diversos tipos de família existentes no Brasil e os princípios concernentes a elas, sendo a adoção por casais formados por pessoas do mesmo sexo versada sob os fundamentos da Constituição Federal, sobretudo enfatizando os princípios da igualdade, liberdade e dignidade da pessoa humana, que necessitam ser amplamente respeitados e tidos como norteadores nas relações homoafetivas e de adoção. Também merecem destaque os princípios dispostos no Estatuto da Criança e do Adolescente, quais sejam: o do melhor interesse da criança e o da afetividade. A presente monografia tem como plano de fundo as opiniões doutrinárias mais relevantes acerca do assunto, com embasamento na evolução jurisprudencial sobre o tema, que firma entendimento de forma positiva sobre a possibilidade da adoção por casais homoafetivos, utilizando-se, para tanto, neste trabalho, o método dedutivo. Desta forma, com todo este acervo, busca-se aqui demonstrar a realidade da família homoafetiva, com o objetivo de demonstrar medidas que possam ser tomadas, visando a efetivação da justiça e um tratamento igualitário. Conclui-se que a adoção homoafetiva, se empreendida através da observância dos requisitos mínimos para um casal se tornar apto a adotar, traz incontáveis benefícios àqueles que adentrarão nos lares constituídos por essas famílias, que elegeram este tão nobre gesto de amor como alicerce e novo sentido para suas vidas.

The present scientific production is based on the analysis of homoaffective adoption as a new conception of family, exposing the transformation of the concept of family, allied to the evolution of legislation on the theme, thus highlighting its role and its importance to society. Therefore, this monograph deals with the development of the family, homosexuality and the institute of adoption and its reflexes over the years. In addition, the various types of family existing in Brazil and the principles concerning them will be addressed, being adopted by couples of the same sex versed under the foundations of the Federal Constitution, especially emphasizing the principles of equality, freedom and dignity of the person human relations, which need to be widely respected and guided as homoafetive and adoptive relationships. Also worth mentioning are the principles set forth in the Statute of the Child and Adolescent, which are: the best interests of the child and the affectivity. This monograph has as its background the most relevant doctrinal opinions on the subject, based on the jurisprudential evolution on the subject, which establishes a positive understanding about the possibility of adoption by homoaffective couples, using, for this purpose, in this work , the deductive method. In this way, with all this collection, it is sought here to demonstrate the reality of the homoaffective family, with the objective of demonstrating measures that can be taken, aiming at the effectuation of justice and an egalitarian treatment. It is concluded that homoaffective adoption, if undertaken by observing the minimum requirements for a couple to become fit to adopt, brings innumerable benefits to those who will enter the homes made up of these families, who have chosen this noble gesture of love as a foundation and new sense for their lives.
