Por fim, este trabalho discute a Lei 12.651/2012 que alterou a o art. 9-A e inseriu os artigos 9-B e 9-C, na Lei 6.938/81, bem como, novos institutos criados nesta lei relacionados particularmente à questão da servidão ambiental.

ABSTRACT

Over the years there were several environmental policies in order to provide the protection of natural resources. The vast majority of these environmental policies base itself up, mainly in command and control instruments, and the Brazilian specific case of infra nature. A major reference in this regard is the Law n. 6938 of 31 August 1981, which provides for the National Environmental Policy. One of the most important aspects of Law. 6938/81 are the instruments of environmental policy, among which you can highlight, due to the recent and significant changes taking place in one of the main environmental laws in force in the country, more precisely, the new Forest Act, the instrument of "environmental easement "which, unlike previously observed trend, it is primarily an economic instrument environmental policy.

In parallel, it is known that since the Constitution of the Federative Republic of Brazil, promulgated in 1988, environmental preservation was definitely incorporated into society after economic development has come to be regarded as inextricably linked to the scope of social, economic and environmental sustainability.

This paper develops a set of relationships between various command and control instruments, especially environmental laws and principles, which provide for the instrument of servitude, looking to deepen their regulatory aspects and its emphasis on the economic nature of a given protection policy to environmental resources, especially the forest nature.

Finally, this paper discusses the Law 12.651 / 2012 which amended the art. 9a and 9b entered the articles and 9c, the Law 6.938 / 81, as well as new institutes created this law particularly related to the issue of environmental servitude.
