ABSTRACT
This work has the objective to study the fiduciary liens of moveable assets from the innovations brought by Law 13.043 of November 13, 2014. The development of the subject resulted in three chapters, applying, to this, the deductive method. The research techniques used was research by using bibliographic material and legal documentation. The first chapter is dedicated to expose the concepts and the guiding principles of the contractual law, emphasizing especially those related to baking operations, as also conceptualize the fiduciary lien. On the second chapter it will be studied the procedural systematic of the judicial action of search and seizure arising from the debtor’s default on the fiduciary lien’s contract as collateral in Brazilian law.
The third chapter leads to demonstrate the changes that will happen on the procedural sphere of the judicial actions of search and seizure, since the advent of the Law 13.043 of November 13, 2014. Faced the creation of this new law, it can be seen its importance, once it is necessary to ensure compliance of contractual rights and duties on the fiduciary lien. However, its essential realize that this law changed radically many items in the Decree 911/1969, which brought several discussions among jurists.
