RESUMO

O presente trabalho de conclusão de curso abordou com maior afinco o SEGURADO ESPECIAL, que mesmo sendo tratado constitucionalmente de forma diferenciada, por não haver obrigatoriedade na prestação da contribuição previdenciária, percebe os benefícios previstos na legislação, tendo como requisitos a obrigatoriedade da comprovação da efetiva atividade rurícola, conforme estabelece o Art. 106 da Lei nº 8.213/91, que se apresenta de forma exemplificativa na lei especifica. Com efeito, utilizou-se de bibliografia especializada, pesquisas em órgãos oficiais como o Sindicato dos Trabalhadores Rurais de Massaranduba/PB, jurisprudências e artigos científicos publicados na internet. A metodologia aplicada será o método indutivo, pois, partirá do estudo de provas e jurisprudências que acompanhadas da legislação vigente aplicável a matéria podem levar a conclusões muito mais amplas do que a análise exclusiva da legislação, caracterizando-se assim a capacidade do Segurado Especial de ter as garantias a todos os benefícios que são estabelecidos perante a Previdência Social, cujas jurisprudências alicerçam que a documentação que comprova a efetiva atividade rurícola não sejam apenas aquelas estabelecidas no Art. 106 da Lei nº 8.213/91 e de forma favorável são aceitas pelos tribunais.

This course conclusion work early form presents an analysis of the historical evolution of the rights of workers seeking guarantees for services for years, are affected by diseases which prevents their work, such as disability, various diseases, and other reasons, which are set out in the general security. Thus, when we enter the rights of policyholders who contributed mandatory or not, at the National Institute of Social Security, had once characterized as insured, guarantees that they will be established for the granting of benefits as pensions, aids disease, disability, maternity pay. Before several members insured Social Security, the topic addressed more diligently the SPECIAL INSURED, that even though constitutionally treated differently, because there is no requirement in the provision of social security contributions, realize the benefits of the legislation, with the requirements mandatory the proof of effective rurícola activity, as established in Art. 106 of law Nº. 8.213/91, which presents exemplary way the law specifies. Indeed, the use of specialized bibliography, research official bodies such as the Union of Rural Workers of Massaranduba, jurisprudential and scientific articles published on the Internet, as well as the methodology applied, which will be used the inductive method, therefore, leave the study of evidence ie law that accompanied the legislation applicable to the matter may lead to conclusions whose content is much broader than the result of the exclusive analysis of legislation, remains subject to the benefit of guarantees capability in favor of the special insured, even if not only through non elencada documentation in the list of special law described above, but through the various decisions of patriotic courts. Characterizing the special insured's ability to have the guarantees of all the benefits that are established and who has a right in Social Security, through case law on the subject, basing the study in relation to the farmer's ability to receive benefits even the documentation supporting their effective rurícola activity other than that established by law, and are favorably accepted by the courts.
