RESUMO

O presente artigo baseia-se na fundamentação teórica relacionada ao auxílio reclusão e a sua função social no Brasil. Tomando como alicerce a linha de pesquisa Direito Previdenciário, amparando-se no Direito público. Este trabalho aborda a temática que é a função social do auxilio reclusão e de como se dar a sua concessão que por vezes é criticada por parte da sociedade. Na tentativa de se criar uma melhor compreensão sobre a importância desse beneficio previdenciário em nossa sociedade e este estudo se empenhou em esclarecer a importância do auxilio reclusão e compreender a sua constitucionalidade no sistema jurídico brasileiro.Os procedimentos adotados no presente trabalho foi uma pesquisa bibliográfica, onde foram levantadas bibliografias sobre o tema abordado com a finalidade de desenvolver o trabalho de forma mais séria possível. A pesquisa bibliográfica foi desenvolvida junto a biblioteca do campus III da UEPB, na biblioteca central de Guarabira, na biblioteca do município de Itapororoca e fontes da internet. A partir do entendimento do instituto estudado e observando as práticas desenvolvidas nesse sistema, pode-se entender que este beneficio se dá para a família do recluso como um meio de garantia de direitos mínimos e proteção dos direitos humanos. O objetivo de tal benefício é o assistencialismo social previsto na carta maior, fim esse que foi alçando e é assim mantido. Por fim não se pode negar que normas regulamentares mais rígidas deveriam ser implementadas, de fato. Porém, é inegável a função social do auxílio-reclusão.

ABSTRACT

This article is based on the theoretical foundations related to aid seclusion and its social function in Brazil. Taking as a foundation to research online Social Security Law, is supporting him in public law. This paper addresses the issue that is to reflect on the social function of aid seclusion and how to get your award is sometimes criticized for our society in an attempt to create a better understanding of the importance of social security benefit in our society and their current dynamics in order to reflect and clarify the importance of aid seclusion and understand their constitutionality in the legal system brasileiro. The procedures adopted in this study was an intense research office, where bibliographies were raised about the topic in order to develop the most serious possible way to work, bibliographical research was developed with the library campus III of UEPB, the central library of Guarabira, in the library of the city of Itapororoca and research taken from the internet and other means of possible access by end in office held If the selection of bibliographic material available on the subject, emphasizing the importance for the development of the study. From the understanding of the studied phenomenon and observing the practices developed in this system can be understood that this benefit is given to the prisoner’s family as a means of guaranteeing minimum rights and ensure the protection of human rights, is the ultimate end that ensures a rights level that is able to preserve its fundamental objective. The purpose of this benefit is expected social welfare in the highest card, so that it was by lifting and is well maintained. Finally one can not deny that stricter regulations should be implemented, in fact. However, it is undeniable social function of reclusion-aid.

INTRODUÇÃO

O presente Trabalho de Conclusão de Curso traz como tema principal o Auxílio-Reclusão. O tema foi escolhido pela grande importância social, que tem como função a proteção às pessoas, ou melhor, a proteção à família, através de um benefício destinado diretamente aos dependentes do segurado.
