ABSTRACT

This work aims to show to Brazilian society that, in Brazil, one cannot think of public safety as the responsibility of only one or a few organizations, it cannot be just the states, municipalities or the Federal Government. Brazil has a System of Public Security, established in the Constitution, which defines missions and the level of responsibility of each organ of this system, having as purpose the preservation of public order and the safety of persons and property. It consists of subsystems preventive, investigative, judicial and penal system, involving the Union, States, Municipalities and society as a whole. There is also a set of laws governing the social conduct, in order to cause people are not driven to commit acts of violence, therefore, of criminal infractions. The Constitution of the Federative Republic of Brazil, promulgated on October 5, 1988, instituted, by the Title IV, Chapters III and IV and its articles, as well as Title V, Chapter II, Art 142 and 144, the Security System Brazilian public. Completed studies, they found that this system has problems in its functionality because it cannot adequately fulfill the main function, which is the full promotion of public safety, given the wave of violence plaguing the country. This monograph is formatted into six sections, in which discusses the problems that involve public safety, especially its causes, taking as starting points the historical facts: the way Brazil was colonized. Of the studies, it was found that the causes of security problems in the country stem from the colonial period. Since its discovery that this country suffers from this problem, because it had begun its settlement with great social differentiation, establishing the clash between classes, generating just nonconformity, consequently, the acts of violence and crime.

1 INTRODUÇÃO
